I. SCOPE

 1.1. These General Terms and Conditions (GTC) govern the contractual relationship between Dantendorfer GmbH (hereinafter referred to as DANTENDORFER) and you as a user of the online shop under the domain dantendorfer.at. You can access the currently valid GTC via the corresponding link on dantendorfer.at. These GTC apply regardless of whether you are a consumer or a business.

1.2. All deliveries, services, and offers on dantendorfer.at are exclusively based on these Terms and Conditions. Any terms and conditions of the user that deviate from these Terms and Conditions shall not apply unless expressly confirmed in writing by DANTENDORFER.

II. CONCLUSION OF CONTRACT

 2.1. The presentation of goods on dantendorfer.at does not constitute a binding offer from DANTENDORFER to conclude a purchase agreement. The presentation is merely a non-binding invitation to you to order goods on dantendorfer.at. This offer is directed only at buyers of legal age.

2.2. The goods you have selected for purchase are collected in a virtual shopping cart. After entering your payment and shipping information, you submit a binding offer to DANTENDORFER to conclude a purchase agreement for the goods in the shopping cart by clicking the “Buy Now” button. Before completing your purchase, you have the opportunity to review your information and correct or supplement it if necessary.


2.3. After you click the “Buy Now” button, we will confirm receipt of your order by email to the email address you provided. Receipt of this email does not yet constitute a non-binding acceptance of the order, unless we explicitly declare acceptance of the order in addition to confirming receipt.

2.4. The purchase agreement between you and DANTENDORFER is concluded when DANTENDORFER accepts your offer within two weeks of receiving your order by means of an explicit declaration via email (declaration of acceptance). The purchase agreement is only concluded upon receipt of the declaration of acceptance. Dispatch of the goods you ordered and confirmation of shipment to the delivery address you provided are equivalent to a declaration of acceptance by DANTENDORFER.


2.5. If we are unable to deliver the goods you ordered because the goods are no longer available or are damaged, we will refrain from accepting your order. In this case, no purchase agreement will be concluded with DANTENDORFER. We will inform you of this immediately and refund any payments already received.


2.6. DANTENDORFER does not provide for separate storage of the contract text. The content is derived from the confirmation email, the acceptance declaration, and these terms and conditions.

III. PRICES AND SHIPPING COSTS

 3.1. All prices quoted on dantendorfer.at include statutory VAT and exclude shipping costs for deliveries to countries within the European Union. If the delivery country is not a member state of the European Union (third country), the prices quoted on dantendorfer.at may include customs duties and other taxes.


3.2. The shipping costs depend on the delivery country and the selected shipping method. The purchase price, including information on VAT, as well as the available shipping methods and their costs, will be displayed during the order process and can also be viewed beforehand under 'Shipping'.


IV. PAYMENT TERMS

 4.1. DANTENDORFER offers various payment options for your goods; however, there is no guarantee that all or specific payment methods will be offered. If payment processing is handled via an external payment provider (e.g., instant bank transfer), the terms and conditions of the respective payment system provider apply exclusively.

4.2. You are generally not entitled to offset any claims against DANTENDORFER's receivables. This prohibition on offsetting does not apply in the event of the entrepreneur's insolvency. It also does not apply to counterclaims of the customer that are legally related to the customer's liability, that have been legally established, or that have been acknowledged by DANTENDORFER.


4.3. You may only exercise a right of retention against DANTENDORFER if your counterclaim arises from the same purchase agreement.


4.4. For orders from users with a residential or business address outside of Austria, or if there are reasonable grounds to suspect a risk of default, DANTENDORFER reserves the right to deliver only after receipt of payment, including any applicable shipping costs (prepayment requirement). If we exercise this right to prepayment, we will inform you immediately. In this case, the delivery period begins upon receipt of the purchase price and any applicable shipping costs.


V. DELIVERY TERMS

 5.1. Unless otherwise stated on dantendorfer.at, shipping to your desired delivery address will take place no later than 14 working days after the payment order has been issued to your credit institution or after conclusion of the contract.


5.2. Goods are shipped via Austrian Post, LogoiX, and DHL.

5.3. If you request shipping to a country outside the European Union (third country), customs duties and other taxes may apply once the purchased goods reach the delivery country. DANTENDORFER has no influence over this.

5.4. DANTENDORFER is entitled to make partial deliveries, provided this is reasonable for you.

VI. CONSUMER'S RIGHT OF WITHDRAWAL

 6.1. If you acted as a consumer when concluding the purchase agreement between you and DANTENDORFER, you are entitled to the following statutory right of withdrawal:

Right of withdrawal


You have the right to withdraw from this contract within fourteen days without giving any reason.

 

The consumer has no right of withdrawal from distance contracts or contracts concluded off-premises, in particular for: goods made to the consumer's specifications or clearly personalized; goods liable to deteriorate or expire rapidly; sealed goods which are not suitable for return due to health protection or hygiene reasons if their seal has been broken after delivery; audio or video recordings or computer software supplied in sealed packaging if their seal has been broken after delivery.

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods (or, in the case of an order for several goods which were delivered separately, the last goods).

You must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. by fax or email). You can use our model withdrawal form, but this is not mandatory. You can find the model withdrawal form here.

Cancellation form

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

 

Consequences of the revocation

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our standard, cost-effective option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

In the case of cancellation of purchase contracts where we have not expressly offered to collect the goods ourselves in the event of cancellation, we may refuse reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods. The goods must be returned in suitable packaging for shipping.

You are liable to compensate for any loss in value resulting from handling the goods in a manner that was not necessary to ascertain their nature, characteristics and functioning.

6.2. Offer to cover return shipping costs by DANTENDORFER

If you wish to exercise your right of withdrawal as described above, DANTENDORFER voluntarily offers to cover the return shipping costs for Austria and Germany. This offer is conditional upon you returning the goods to DANTENDORFER in accordance with the instructions included with each delivery, using the logistics partner specified therein. Otherwise, you will be responsible for the direct costs of the return shipment as outlined in section 6.1.

This voluntary offer by DANTENDORFER to cover the return shipping costs does not, of course, affect your statutory rights and claims, and in particular your statutory right of withdrawal in accordance with section 6.1.


Returns from outside the EU:
Returns from countries outside the European Union (customs countries) are not possible.

For international deliveries outside the EU, additional costs may apply, including customs duties, import VAT, bank charges, transfer fees, and currency conversion fees. These costs are not included in the purchase price and are borne by the customer. Billing is generally handled directly by the relevant authorities or payment service providers in the recipient country.

Before placing an order, it is recommended to check the applicable import regulations and possible additional costs in the respective recipient country.

6.3. Discount codes

In accordance with our Terms and Conditions, we would like to point out that each discount code can only be used once per purchase and per customer. Any other redemption conditions are stated in the respective promotion and are accepted by the customer. Only one discount code may be used per order, and combining different discount codes or applying customer discounts is not possible. Cash payment of the value of discount codes or any other offsetting is also not possible and is subject to the specified conditions. Customers are advised that promotional vouchers may have restrictions. These could apply to certain collections, selected goods, specific product range segments, or a minimum order value. These conditions are always described in the promotional terms and conditions and cannot be subsequently changed or extended. Discount codes issued to customers are non-resaleable and are linked to the customer data or email addresses to which they were issued. Any transfer to third parties is prohibited.

6.3.1 Refunds for discounted goods / discount codes

In the event of a return of individual products used with discount codes, a percentage refund will be issued. This refund is based on the value of the goods and the discount amount or percentage discount specified in the offer. For orders of multiple items, there is no entitlement to the full discount being deducted from the goods actually purchased in the event of a partial return. The return period is 14 days from receipt of the goods.

VII. RETENTION OF TITLE

The delivered goods remain the property of DANTENDORFER until the purchase price has been paid in full.

VIII. WARRANTY PERIOD

 

DANTENDORFER is liable for material and/or legal defects of delivered goods in accordance with applicable legal regulations.

IX. LIABILITY

 

9.1. DANTENDORFER is liable to you for intent and gross negligence in accordance with statutory provisions. For slight negligence, DANTENDORFER is liable – unless otherwise stipulated in section 9.2 – only for breaches of a contractual obligation, the fulfillment of which is essential for the proper performance of the contract and on which you, as the user or buyer, may regularly rely (so-called primary obligation), and then only to the extent of foreseeable and typical damages. In all other cases, our liability is excluded, subject to the provisions of section 9.2.

9.2. DANTENDORFER's liability for damages resulting from injury to life, body or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

X. COPYRIGHTS

 

Please note that the content on dantendorfer.at, in particular images, logos, manufacturer information, and texts, is generally protected by copyright and/or trademark law. Any use of this content beyond the intended use of dantendorfer.at may infringe the rights of DANTENDORFER or third parties and may result in legal consequences, such as injunctions and claims for damages.

XI. CONSUMER INFORMATION WITHIN THE EU

 

For the out-of-court settlement of consumer disputes , the European Commission has established an online platform (“ODR platform”) which you can use to initiate out-of-court dispute resolution. You can find the platform at “https://ec.europa.eu/consumers/odr/ . We are generally willing to participate in dispute resolution proceedings before a consumer arbitration board.

XII. VOUCHERS:

Scope of validity, voucher purchase
These terms and conditions apply to all purchase vouchers issued by Dantendorfer GmbH, Austria, to consumers. Discount vouchers are excluded. In cases where special conditions apply to individual voucher types, these take precedence over these terms and conditions. Our offer is not directed at businesses. According to § 1 of the Austrian Consumer Protection Act (KSchG), a consumer is any natural person who enters into a legal transaction for purposes that are neither related to their commercial nor their independent professional activity. Vouchers cannot be combined with other discounts or customer-specific rebates, nor can they be applied to the purchase of a voucher.

Validity period
The voucher is valid indefinitely from the date of purchase.

Redemption
Gift vouchers can be redeemed for the entire product range (excluding gift vouchers) in all Austrian Dantendorfer stores and in the online shop. Redemption is only possible with the original voucher. Cash payment is not possible. If the issued voucher specifies different redemption conditions, these take precedence.


Vouchers are issued in Euros and can be purchased and redeemed in the following countries: Austria, Germany, Belgium, Bulgaria, Czech Republic, Denmark, Spain, France, Croatia, Italy, Hungary, Netherlands, Poland, Portugal, Romania, Slovenia, Slovakia, Finland & Sweden.

Vouchers are generally non-transferable, unless explicitly stated otherwise.

Exchanging vouchers
A refund or cash payment of the voucher amount is generally excluded, except within the framework of the statutory rights of return and cancellation. In this case, these rights extend to 2 days from the date of purchase, provided the voucher has not already been used. The voucher will then be canceled immediately and is therefore invalid.

Liability
Dantendorfer reserves the right to cancel or block the voucher if there is a legitimate reason, such as loss or misuse. In this case, you will be informed of the cancellation or blocking of the voucher.

Applicable law
Our business relationship is governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-laws rules (IPRG, EVÜ).

FAQ / Instructions for using vouchers


Shipping of print-at-home vouchers is free. By purchasing a print-at-home voucher, you agree to receive the invoice by email.

Payment by voucher in the online shop
Payment with vouchers is made by entering the voucher code in the corresponding field during the checkout process under "Discount Codes and Vouchers" and then clicking "Apply". If the order value exceeds the voucher value, you must select one of the available payment methods to pay the remaining amount.

Multiple vouchers can be redeemed per order. Enter the codes one after the other in the "Discount Codes and Vouchers" field and confirm each one individually with the "Apply" button. If the voucher value exceeds the order value, the remaining amount will be retained as credit for future purchases. The voucher code remains valid until the entire credit is used up. Cash payment of the voucher value is not possible.


If you return products purchased with vouchers, the amount paid with the voucher will be credited back to the voucher. The voucher remains valid and can be used for your next order.

Payment with vouchers in our stores
Vouchers purchased online – both via postal delivery and as a print-at-home option – can be redeemed in our stores throughout Austria.

Special rules for partial redemption in store
Gift vouchers purchased both online and in-store can be redeemed in our branches. However, if only part of the voucher is redeemed in-store, the remaining balance cannot be used online. The credit will be issued as a receipt, which you can present and redeem for future purchases exclusively in our branches.

Payment with vouchers purchased in the store
Gift vouchers purchased in our stores from November 1st, 2024 onwards can be redeemed in our online shop. Please use the voucher number located in the bottom right corner of the voucher for this purpose.

After redemption in the online shop, we refer to the customer data that was provided during the ordering process.
The purchaser or the person redeeming the voucher confirms that they are authorized to use it. In the event of voucher misuse, the order information will be used as proof of unauthorized use. This data may be used to investigate the incident. However, Dantendorfer assumes no responsibility for any claims for damages by the affected parties in this case.

XIII. OTHER:

 

13.1. Complaints can only be submitted in writing to the address listed below under the "Contact" section.

13.2. The contractual, ordering, and business language is German. English content is displayed on our website at www.dantendorfer.com. Please note that translations may contain errors in grammar, spelling, interpretation, and opinion.

13.3. Our business relationship is governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods and the conflict-of-laws rules (Private International Law Act, Lugano Convention).

13.4. These terms and conditions remain binding in their remaining parts even if individual points are legally invalid.

13.4. In contracts with businesses, the exclusive jurisdiction of the competent court for A-5020 Salzburg is agreed upon, and any other jurisdiction is excluded; for consumers, the competent court is the one in whose district the consumer's domicile, habitual residence, or place of employment is located.
